This training course is based on the compliance requirements placed on Trainer Courses Ltd by the Mental Capacity Act of 2005 and Deprivation of Liberty Safeguards introduced in 2009. The requirements placed on the company by the above requirements and CQC Inspection Standards have been used as reference points for this training course.
Apart from ensuring compliance with the above, the trainer pack is useful in assisting Health & Social Care Diploma candidates with the various elements of their learning.
A new regulation that came into effect in April 2015: Regulation 13 Safeguarding service users from abuse and improper treatment. – The intention of this regulation is to safeguard service users from suffering any form of abuse or improper treatment, such as discrimination or unlawful restraint while receiving care and treatment. This would include inappropriate deprivation of liberty under the terms of the Mental Capacity Act 2005.
